New Mexico Educational Retirement Board withholds records.

Frank Foy and his attorney have asked the Educational Retirement Board to surrender public records for inspection as provided for in the New Mexico Inspection of Public Records Act.

The ERB and their attorney have denied the request in toto.

I am not a lawyer.
And having read the request and the reply,
it seems that there might be an valid objection or two
to complying with the entire request as written.

Some parts at least, though, could have been surrendered,
and rather immediately.

So why are the ERB lawyers obfuscating the delivery of at least
some of the records, by making objections and refusals that
are not going to survive for even one minute before a judge?

They do it for the same reason dogs lick their privates;

... because they can.
