Rigo Chavez denies public records request

Rigo Chavez writes;

"The only report brepared by an outside investigator was one dealing specifically with allegations against former APS Police Director Gilbert Lovato. Because this report is a "memorandumwhich is a matter of opinion in Mr. Lovato's file, it is not subject to disclosure under the NM Inspection of Public Records Act. Therefore your request is denied."


From the New Mexico Inspection of Public Records Act;

In some instances, a record kept by a public body
will contain information that is exempt from the
right to inspect as well as information that must
be disclosed.
The Act requires the applicable records custodian
to separate out the exempt information in a file or
document before making the record available for
inspection.

The fact that a file may contain some information that
may not be disclosed does not protect all the
information from public disclosure.
In order to press the point, I will have to take APS Modrall to
court. They will make a mint litigating against the public
interest.

Anyone who doesn't think that APS Modrall will win in court
underestimates the power of Modrall, and a virtually
unlimited budget of taxpayer support for "education".

The leadership of the APS is either honest or it is not.

The test is to ask them to tell the truth.
If the answer is no, then they are not honest.

Any answer except yes, means no.

Somebody should do something.
