Savage responds to Lovato's allegations

The following rebuttal was posted on the District's Website.

Mr. Gil Lovato’s allegation that one of his superiors at Albuquerque Public Schools asked him to perform an improper and illegal background investigation is false. Tom Savage denies these allegations categorically. If there was an improper background check done as Mr.Lovato asserts, it was either done by him or at his direction without Mr. Savage’s knowledge.

Both the timing and the method of this disclosure further undercut the credibility of Mr. Lovato’s allegation. Instead of immediately reporting or documenting this alleged unlawful act when it happened, Mr. Lovato appears to have raised it for the first time only after the district decided his contract would not be renewed.

In addition, instead of reporting the matter to the proper authorities, he made the allegation to the news media on the heels of threatened litigation against the district. Making false accusations about misconduct of anAPS official in the press, months or years after it allegedly occurred, raises serious questions regarding the motive for
his statements.

While the district does not comment publicly about matters of litigation, and will continue to follow that policy, it felt compelled to respond based on the improper assertion of Mr.Lovato’s comment by his legal counsel. If Mr. Lovato decides to pursue a lawsuit against the district, the district will respond to his claims in the context of that lawsuit.
A few things about the rebuttal bear consideration.

The venue is cowardly. Public servants must make a reasonable provision to stand and deliver responses to legitimate questions about their public service and public power and resources; on the record. "no comment" is no longer acceptable response.

I doubt seriously that Rigo Chavez is the author. I would invite you to read a few of his other releases and compare them critically. If it was not in fact written by Art Melendrez or some other lawyer(s) from Modral; I'll eat a bug.

There is a body of sworn testimony, and hard evidence that represents the best approximation of the truth about the criminal battery of privacy rights, and the alleged criminal misuse of Bernalillo County Sheriff Darren White's computers.

Maes/Modral/Everitt/and Darren White will not surrender that body of public records; even in violation of the law. The litigation that will except the leadership of the APS from accountability to the law, will be paid for by unwitting taxpayers.

Taxpayers will pay exorbitant salaries for unscrupulous lawyers who will litigate against the public interests; at the behest of, and in the personal interests of the leadership of the APS.

In so far as "...the district does not comment publicly about matters of litigation, and will continue to follow that policy..."

says who?

The policy was established and is implemented only to provide a plausible sounding cover for hiding truth and evidence."

The truth is; the leadership of the APS and Modral, do not release the truth, testimony, or evidence about matters in which they might be the defendants in civil lawsuits and criminal prosecutions.

Technicalities, loopholes, and legal weaselry will be used to suppress and manipulate the truth.

This is exactly the kind of behavior that is explicitly and expressly forbidden by the Pillar of Trustworthiness;

It is why they had to except themselves from accountability to any standard of conduct with the word "ethical" in it.

The Pillars of Character Counts represent a code of ethical conduct. The code is widely recognized, accepted, and respected code of ethics. It is the student standard of conduct.

It is the standard of conduct to which the leadership of the APS is no longer accountable. As the senior role models for 89,000 students; they are no longer honestly accountable to the student standard of conduct. By their deliberate choice, they will no longer lead by their own personal example.

I can not imagine an acceptable justification.

No justification, acceptable or otherwise, has been offered. The leadership of the APS will neither explain, defend, or even acknowledge that they have excepted themselves from accountability to the student standard of conduct. They have abdicated their obligations and responsibilities as role models.

Nor is any justification is offered by the person(s)at the newspapers who decided that this truth will not be investigated nor reported upon.

...deciding for the citizens of Albuquerque; that the question will not be asked over, and over, and over again, until there is a principled resolution of the allegations of public corruption, incompetence, and criminal conspiracy in the leadership of the APS.

When I am made to eat a bug, I try to remember they are pretty nutritious! However, even if some All Knowing Oath-Genie eventually held you to test on YOUR bug oath, STILL would your stomach be insect-free!

I know, I have too much time on my hands.
