District Attorney Kari Brandenburg would like you to believe that your interests are her interests.

But they aren't.

Your interests are served by finding the truth about the public corruption and criminal conspiracy in the leadership of the Albuquerque Public Schools and the Bernalillo County Sheriff's Office.

Kari Brandenburg is serving someone other than you. She is serving the interests of those who do not want the truth to be made public. In this case; that would be Beth Everitt and Darren White. Neither of them want you to know the truth about how members of the leadership of the APS and the BCSO conducted illegal background searches; felony criminal misconduct.

Darren White in particular, does not want the truth to be part of his campaign for congress.

Evidence of the misconduct was supposedly turned over to Kari Brandenburg. She was to determine if criminal misconduct had taken place; and whether or not criminal charges would be filed. That was months and months ago.

I would like to know if she has done anything at all. I would like to know if she is just sitting on the evidence; waiting until I am the only one who cares anymore.

I would like to know if she has betrayed the public trust.

So I made a request for the public record. I requested a "billing statement" or other public record, that shows that the DA's office has spent even one hour investigating the public interests in this scandal.

In response to the request; Kari Brandenburg wrote;

"Records from ongoing investigations and pending prosecutions are not subject to the Public Record Act."
Kari Brandenburg, unless she is the Custodian of Public Records for the District Attorney's Office; had no business responding to the request. Her responsibility under the law, if she is not the rightful Custodian of Public Records, was to immediately forward the request to the rightful custodian of records.

There are two kinds of public records in the custody of the District Attorney; those that are related to the scandal in the APS police department; and every other record they hold. There is one record in common to both groups; the record that shows whether or not the investigation has even taken place.

Brandenburg claims that record is so much a part of the investigation of public corruption in the APS/BCSO scandal; that it cannot be made public in the public interest.



Sounds like legal weaselry to me.
