APS to waste more tax dollars

There exists, incontrovertible truth about the involvement of senior APS administrators in felony criminal misconduct, link. That evidence exists in the form of a public record; the final report on an independent investigation of testimony and evidence.

APS Custodian of Public Records Rigo Chavez, has expressed the intention of the leadership of the APS, to deny stakeholders their right to inspect and/or copy that report.

A great deal of money is going to be used to litigate against the surrender of the truth to public knowledge.





APS Supt Winston Brooks will spend tax dollars to hide the truth about the ethics and accountability scandal in the leadership of the APS.









APS/Modrall Lawyer Art Melendrez will be paid (tax dollars from unwitting citizens who believe the money they give over for education is actually being spent on their children) to litigate against the public interest.


He will do so, without consequence, by arguing legal nonsense. He will argue that the investigative report we paid for, is;

a "letter or memorandum which (is) a matter of opinion in a personnel file" and is exempt from disclosure under the act.
Nonsense of course, but Melendrez and Modrall are going to make a boot load of money arguing otherwise.

I once asked for "any public record" which would reveal the number of tax dollars that flow to APS' lawyers (at Modrall) under the unlimited budget arrangement they have with tax payers in APS. The number is so embarrassing, they didn't surrender it.

Modrall can swing both ways on the issue of hiding the truth from tax payers; they also have a lawyer, link, and a few friends on the Board of Directors of the New Mexico Foundation for Open Government.

One of their friends on the NM FOG Board of Directors, APS School Board President and Open Government Lawyer Marty Esquivel should be outraged.

It doesn't appear that he is.





Even under the best of circumstances, suing is a crap shoot;
the Justice System offers no guarantee of justice.

APS budget for litigation is unlimited,
as in their influence on the justice system.

They will litigate with every resource available to them
for ever rather than have to account for their incompetence
and corruption.

Your choice is whether to continue to allow them to.

The power is ours, the resources are ours,
the truth about their spending is ours.
