KRQE offers a report, but no link yet, on a recording made of Governor Susana Martinez' Chief of Staff Keith Gardner talking about using private emails to conduct public business, the need to avoid "discoverable" communications within his public service. He would rather, he said, avoid "court or jail".
Blogger Joe Monahan offers the clip, link, that KRQE did not.
Gardner's defense; the clip was taken out of context and used for political reasons.
So what? In what context could his statements lie, in which they would be even remotely OK? And who cares why his misconduct is being exposed? Must misconduct be exposed only by someone the perpetrator approves of and only for motives also agreeable to the perp?
The question is not whether this is "illegal".
What he suggested and did, might not be "illegal".
That it manifests egregious disregard for the spirit of the law is damning enough.
The question is, should he resign or should he be fired?
